According to two American officials familiar with the project, the administration of United States President Joe Biden is drafting an executive order to standardize the approval process for private rocket launches as part of a larger effort to provide legal and regulatory clarity for American businesses on everything from space travel to private space stations.
The directive would be a part of a campaign by the White House’s National Space Council to update American space regulation, which has fallen behind the accelerating pace of private sector investment and research.
The directive, which is anticipated to be ready for Biden to sign by early 2023, is intended to make it easier to obtain licenses under current regulations for more commonplace space activities like launching rockets and placing satellites, according to one of the sources who declined to be identified.
One of the sources stated that the directive will mandate the US Department of Commerce with developing an online platform to assist businesses in navigating numerous agencies’ licensing procedures for space-related activity.
Kamala Harris, the vice president of the United States and chair of the National Space Council, has indicated that she wants to codify new regulations for commercial space operations, although the details of the executive order have not been made public.
Requests for response from a Harris spokeswoman were not immediately returned.
While previous administrations have not made much progress in updating U.S. space laws, the Biden administration’s larger initiative to encourage new regulations, in addition to those addressed in the executive order, comes with additional urgency due to the rate of private investment in space. Several of NASA’s low-Earth orbit operations are being privatized, according to the agency.
It is anticipated that businesses like Elon Musk’s SpaceX, Jeff Bezos’ Blue Origin, Boeing, and many others will invest billions of dollars in projects like private space stations, service satellites, and spacecraft in orbit during the next ten years.
According to one of the sources, a group of US government representatives working on the executive order are also looking into methods to get Congress to pass legislation designating certain federal agencies with the responsibility of sanctioning and overseeing those space endeavors.
Before new regulations take shape, the executive order is regarded as a first step toward simplification of current restrictions. Companies like Blue Origin, Axiom Space, and others are building private orbit stations, but their methods for wooing foreign governments as clients or carrying out their objectives in space are not apparent.
